Frequently Asked Questions

Q. How will the claims process work?

A. We will assess your claim inquiry and advise you if we feel it is a claim we can assist you on and then recommend a solicitor from our panel.

Your claim will only be handled by one of our panel of experienced personal injury compensation lawyers who will guide you through the legal and medical issues and keep you fully informed every step of the way. The claims process will depend on the complexity of your case, but typically your solicitor will:

You may then be offered compensation. Your Solicitor will advise if this is the best possible outcome and whether to accept the offer. In some cases, they can arrange for interim payments to be made to you.

Q. How long will the claim take?

A. This depends on how complicated your case is. Most cases are settled within a matter of months. A few, very complicated cases, involving complex issues that might take quite a bit longer to resolve, can take a year or more. The Solicitor will be able to advise you at the outset as to the likely timescale for resolution of your claim.

Q. How long do I have to claim?

A. This depends on the injury type, however, it is generally 3 years from the date of the accident.

There are exceptions to this rule, for example;

-If the injured party is a child, then the three years starts from their 18th birthday

-claims involving accidents abroad may change depending on the laws of the country the accident happened

Q. Why shall I choose Smart Accident Claims?

A. Because we will ensure to look after you and your needs in the best possible way. We also have the necessary network of solicitors who expertise in different types of injuries to be able to get the maximum compensation due. We do not believe in one man bands who try to cater for everyone’s needs, because that just means you are not a specialist in any particular field. Our large panel of solicitors enables us to instruct the best specialist for each individual claim.

It goes without saying that we are reliable, discreet and professional and are here to help you get what you deserve.

Q. Do I need to attend your offices for meetings?

A. We usually deal with a case by telephone and through the post which means we do not need to arrange face-to-face meetings. However, you are more than welcome to visit our premises should you wish to do so

Q. Will I have to go to court?

A. This is very unlikely over 90% of cases do not go to court. The insurance company does not want to waste time and money defending a case where the facts clearly determine who is at fault. For this reason the vast majority of cases are settled without court appearances.
